When a married couple who have children go through a dissolution of marriage proceeding, there are going to be a number of details that need to be attended to, and one of them will be the the matter of shared parenting or child custody. Most parents understand the dynamics of the relationships that exist between themselves and their children and they have no problem reaching an agreement that they feel is in the best interests of everyone concerned. Once the primary physical custodian of the children has been established, the non-custodial parent will be required to pay child support. The recipient of the payments is known as the “obligee;” the parent making the child support payments is the “obligor.”
The original amount of child support that is going to be ordered by the court or agreed upon by the couple involved will be calculated using the Income Shares Model in tandem with the Florida Child Support Guidelines. However, this amount can be modified when the financial circumstances of the parties involved undergo changes. According to the Florida Statutes, the altered financial dynamic must result in a change in the required child support payment of at least 15% or $50 to be deemed significant enough to warrant a modification.
Because people usually make more and not less money over the years and the cost of living and the needs of the children generally increase, child support modifications will usually result in an increase in the amount that must be paid by the obligor each month. However, in cases when the financial situation of the obligee improves and/or the obligor suffers a financial setback, a child support modification that reduces the payment amount can be in order as well. It should be noted that multiple child support modifications are possible over time as long as the 15%/$50 standard is met.
